Judge Makowski decision overturned by 4th Appellate Division

I have just gotten word that the decision by Judge Makowski to toss Paul Clark off the ballot was overturned today. The only reason stated was that the Board of Elections was not served in the lawsuit within 14 days. This is going to the NYS Court of Appeals. The reason it is going up further is because Judge Makowski specifically gave our lawyers permission to serve the Commissioners of the Board of Elections on day 15 because the lawsuit wasn’t signed by a judge until after 5pm and the BOE was closed at that time. The judge told our lawyers not to go to their homes but just wait till the next day.

This was the easy way out for the 4th Appellate Division and everyone expected it to go to the next level regardless of who won there. So onto the NYS Court of Appeals or as commonly known as the Court of Last Chance!

Just a reminder the issue of the IP reorg is still pending and this can toss everyone off the IP line except IP members.

Helping Clark appear in the voting machines is good. This should draw some votes away from Keane, helping Collins.
