That’s right folks, Sandra Rosenswie and the newly elected Erie County Independence Party won in court today. The decision handed down was that Orsini’s control has ended with the dismissal of Anthony Mingarelli’s claim that the reorganisation meeting was invalid.
This means that the Erie County Independence Executive Committee is free to operate as political party free and independent of any NYS IP control.
What’s even better is the further ruling that a hearing shall be scheduled to determine if the NYS Independence Party has the right to file any endorsements within Erie County and if the newly created rules of the NYS Independence Party are proper and binding on any county party.
We filed this cross petition to stop the NYS IP Executive Committee from filing cross endorsements against any candidates that our party decides to run in up coming elections. The rules of the NYS IP have never been challenged and the small parts of their rules that have been challenged were beaten in court.
I expect the rules of the NYS Independence Party to be declared null and void in Erie County and the will of 22,000+ people as a political party to be upheld in court. People from Albany and around the state should not have the right to decide who is a candidate for our party in Erie County.
The biggest part of the whole deal is that Tony Orsini no longer has any control anywhere. All he can do is beg and plead for his choices to be recognised by the local and state Independence Party. Thank God We Are Free!
